Incomunicado detention and torture. Assessments using the Istanbul Protocol
This Report examines forty-five cases of detained prisoners in incommunicado regime in the Basque Country. It has involved over thirty health professionals and eight different organizations, including the IRCT who provided methodological support.
The study points out judicial recommendations to the State, and Legislative Institutions, as well as the Ombudsman regarding the documentation of torture, the access to justice, the assistance to victims and potential reparation measures. This report constitutes the first one made in the Basque Country taking as reference the Istanbul Protocol to establish
practices of torture and ill-treatment, and it is pioneer in the scientific approach applied to the standards and principles of the Protocol.
